Ruling Toxicroak EX and Triple Poison

This may be straight forward, but if toxicroak poisons another Pokemon using triple poison then is switched onto the bench, Does his poison effect of 3 damage counters still apply on that Pokemon if he isn't in the active spot?

If you use Triple Poison, and Toxicroak retreats to the Bench, the effect would still be on your opponent's Active Pokemon. If you use Triple Poison, and your opponent's Active retreats to the Bench, the effect would be removed because Pokemon on the Bench cannot be affected by Special Conditions.
