You can always fail a Pokemon Communication, the reasoning is that your deck is not Public Knowledge, so your opponent doesn't know what's in it all the time.

Well 1) It's self-referencing, so it's referring to the card that you just played. It means that if you have cards in your hand, other than that particular card, then you can't play it. 2) The card says that you can't choose Mysterious Fossil, or a card that is put into play. You can't choose...

The reason being that the deck is not public knowledge, and you can fail any search (with a few exceptions: namely PokeDrawer+)
