Ebay problems..help!

hi,
I recently bought a pokemon card on ebay. The card is Regice Star, and the description only said "I'm helping my son clear out his pokemon cards. The card is Regice Star in good to very good condition" and the auction had a picture of the card.

So I received the card today and...it isn't holographic. From far, it looks like it's holo because of the little stars and round halo-looking circles..but it's not holographic at all...plus the card is scratched..

Now my question is...is this a fake card? Or did they officially release a non-holo version as a promo that I didnt know of. And second question, what should I do? I contacted the seller to ask about it, but the description didn't really say "Holographic card" , so even if I file an"item not as described" claim with Ebay, I don't know if I really have a chance of winning..
What should I do?

I'm not sure about the "fake" aspect, but from an eBay perspective, it was a BIG mistake to trust anyones definition of the condition of a card. It is your responsibility to send them a message asking "does this card hae any bends, creases, scratches, (and other damages you don't want here)?", I usually do it even if it's provided in the listing just to make sure. I usually avoid mothers, children, and anything but strait out of the pack. Paypal will not side with you if you file a claim on either the condition (I've learned it the hard way) or the holographic aspect (why would you ever only go by the picture?).
 
Well, looking at the auction...I can tell by looking on the text of the card that it is indeed a fake card. Unfortunately, the seller sold the item as described, and since she didn't mention the holo aspect, or the authentic aspect...you may just have to live and learn on this one.

Yep, it's a fake.
My friend (PikaFlash from here) did the same thing....this is what he did.
He compared it with my one....his one turned out to be a fake...so he asked the seller for a refund, which he did & got his money back.
