Has anyone received a damaged card from Ebay?

So I finally received my Gold Zekrom in the mail today. I got it for a decent price around 20 dollars.
However upon opening the package I was horrified. The seller did not use a top loader!!!
So as you can imagine the card is completely bent up and almost looks S shaped. I was not happy.
I purchased on Ebay. I guess that's what I get from some idiot on there.
Anyway I filed a complaint and am awaiting the sellers response for either a full refund or replacement card.

I prefer to use Amazon. did you read the description before hand to make sure that he didn't mention that he wouldn't use a top-loader or that it was already damaged. The only issue i have with eBay isn't damage, but rather being late.

I have ordered hundreds of cards off ebay and it has never been a problem until today. I just find it baffling he didn't put it in a top loader. I mean they are about 10 cents a piece if that.

You can actually put a claim in now to Ebay and contact the seller, you can more than likely get a refund, or a new one sent.

Yes you are correct. I did put in a claim and I am awaiting the sellers response.
Worse comes to worse I can file a claim through paypal also. It's rare I have to leave a negative feedback but I will if he refuses to refund or replace the card. There is no excuse for putting the card in an envelope in a penny sleeve but not toploader. It would have been fine in a toploader. I even sent him pictures to show him the damage of the card.

Sellers are obligated to ensure their product arrives safely.

That being said, eBay will side with your case and the seller probably knows that. He will likely offer a refund or replacement, but in the event he does not respond accordingly then eBay will ask you to return the damaged card for a full refund. Be prepared to send with tracking so that you proof of shipment. Unfortunately, some sellers do not send cards properly and they do arrived damaged. I've purchased "Mint" cards only to receive a heavily played one.

All you can do is contact the seller and file a complaint if necessary. I would also avoid that seller in the future.

Yep, I bought a few classic cards off Ebay that were listed as M/NM one came in down right horrible condition, once I made it a notice to Ebay and the seller it was "I will get you a full refund right away, please don't let this put a bad rep on us". Now I'm added to a discount buy list AND I got a refund. :) Specially if it is a higher rep seller or an actual store on ebay, they'll bend over and back around to keep a good rep. I also agree, I haven't done repeat business with anyone that has messed up the first order.

This turning into a big mess. The seller says the card should have been fine because it was in a bubble mailer. I informed him a paper thin card will not survive even in a bubble mailer if it's not in a top loader.
I have a feeling he is going to fight this tooth and nail. I just want another card or a refund. He's stalling. I even sent him pictures of the packaging and the card.
He says I purposely damaged the card and don't deserve a refund or new card. Why would I damage a card for my personal collection?

Here is the next 2 messages he sent me.
I have mailed cards before: baseball, football, basketball and collectable (like pokemon) in these mailers in the same manner and never had an issue. You see my ratings, obviously I'm not out to scheme the buyer. If you have a legitimately received the item in poor condition, I am willing to work with you.

And:
I see the bend, but that is not enough to warrant a full refund. If you want a partial refund, I can abide that for that damage. You can send it back for a full refund.

I am awaiting his response that he will give me a full refund.

Man as a collector that almost pains me to see X_x But, if you've filed a claim with eBay saying the item was not received in the condition the listing described then eBay WILL side with you and give you a refund. If the seller doesn't want to cooperate too bad for them, strike them down with a negative feedback. eBay ALWAYS sides with the buyer though, so you really don't have anything to worry about.

BTW, who is the seller so I know to avoid them when I buy stuff?

Mailing a card without putting it in a toploader is foolish.

I would advice everyone to avoid him like the plague.

I am still awaiting his response yet.

As both an eBay buyer and seller, I think that would be the most satisfying resolution for both of you...you get your money back, and he gets the card back to resell (hopefully for less money than you paid).

Bottom line: he messed up, but seems willing to work out an agreement. I'm assuming you're planning on taking him up on the return for refund, but if you're not, I urge you to reconsider. I've heard horror stories from sellers in similar situations where a card isn't in expected condition, buyer files a complaint, and keeps both the card (sometimes still in great condition) and the money. Like I said, I'm certainly not accusing you of doing this, I'm just viewing the situation from a seller's POV.

All I want is a refund from him. I told him I would gladly send back the card and if I get my full refund he will get a neutral feedback.

I just bought a promo BW ninetails earlier this week. Seller did NOT use a toploader and penny sleeve! I was mad because they put it in a wedding invitation (no names or such), but the invitation had a fake diamond gem inside it.....the little gem punched lots of lil hole-like-dents all over the picture of the card! It even ripped the foil in 1 tiny spot. advertised as brand new, mint condition. I reported a problem.....seller said they wanted proof. i said send me your email and i will email photos, scans, or video. they did not send me email, but just issued a refund without anything further said.

I did tell the seller "cards should always be mailed in a toploader" so hopefully they will learn!

Sounds to me like he's upset about the auction only going to 20 bucks and so carelessly packaged it. I have gotten a damaged full art Bianca SR 1st edition from Japan but at first I thought I damaged it. I then tested how much force needed to make that crease. There's no way I could've opened it accidentally and bend it that direction with that much crease... and so I messaged him politely and he IMMEDIATELY refunded me. I felt bad that the post office mishandled it so I just paid for shipping.

Point I'm trying to make is that this guy is a bad seller. Don't waste anytime with this guy and open a case as soon as you can.

he's an idiot.

1) He openly admitted he doesn't use toploaders.
2) He thinks you want to scam him. Soooo you got a good deal on a card... you bent it and showed him the pic all to get your money back? You just missed a chance to save 15-20$ in this card. And you have to return it.... makes sense to me... :S ...if you were really trying to scam him you would pull a "it never arrived" tale.

Dont argue with him anymore dont inform him of negative feedback or anything. He'll say you're using feedback extortion. You asked nicely to refund a damaged item and he refused. You can just go ahead and file a claim.

What? The seller already sent fezwhy a message saying he'd give a full return for return of the card -- he never refused.

At worst, the seller deserves a neutral rating for the issue; he's clearly willing to work with fezwhy to find a solution ("You can send it back for a full refund.") so a negative feedback isn't warranted.

I agree.

As a precaution, it is not wise to inform sellers of your intention to leave Neutral or Negative feedback (regardless of whether or not it is justified). You can expect eBay to side with the seller if your communication is "misconstrued" as feedback extortion.

Leave your messages as "you sent me a bummed card" if and only if he gets hostile over the situation, which some of it did seem he was coming off as a butt.. Straight to the point, never inform them of your intentions on rating, if they take a long time in a solution or act as how I listed above then you should send a bad rep.

For now, try to reason with him and stay in contact, make sure you get your full refund.
