Ruling Tyranitar ex

Is Tyranitar ex which is found in three new EX tins released in March in the Modified Format, even though it is in Promo 1?

That Tyranitar ex can't be used anymore because it is no longer in the modified format...

P.S. IMO, I think what i said above is true but please correct me if i'm wrong...

There's a Tyranitar ex in Unseen Forces (a legal set), you know.

We won't know until we can see what that Tyranitar ex can do.
