Yes you have to have StreetPass activated in your game and receive the upgrade from Mr. Stone.

Then you either have to physically pass someone or go to a Nintendo Zone where someone who had it just was.

Nintendo is having a World StreetPass Holidays now I think that means that non-local records are being made available in more remote Nintendo Zone locations.

I know some McDonalds are really Nintendo Zones.
