I really doubt it. Those packages you see at stores like Target, Kmart, or Wal-mart are packaged by a third party vendor not associated with Nintendo. The old sets like Neo were made by Wizards of the Coast.

I only buy sealed booster boxes. Yes, it sounds like the packs have been weighed. I seriously doubt that eBay would side with you with the situation you described. However, if you attempt to leave a negative ref to the seller, your case does go to dispute automatically.
