Ruling Foul Play vs. Black Ballista

I hate when I don't know the answer to something being a Professor myself.
But that's why you lovely people are here.
My question, can Zoroark's Foul Play copy a Black Ballista if it only has a DCE or 2 Basic Energy attached to it?
Black Ballista doesn't state it has to have 3 Energy available to discard to be able to use the attack (which is obvious anyway), so would Zoroark just lose all of it's Energy?

Zoroark would lose all of its energy. You do as much as you can since it doesn't state if you can't discard this attack does nothing. That is why you can copy Blue Flare from Reshiram and not discard if you don't have fire energies attached to Zoroark.~KA
