1. Yes. The format is MD-on, as well as any promo with number DP22 or higher. Its number is DP41, so it's legal.
2. No; the power is self-referencing. The one you pick up with Leap Away is the one that actually used the power.

Just for future reference, whenever a card like Toxicroak G Promo says something like that, see if you can replace the name of the card with "This Pokémon". If you can, its self-referencing so you cannot use it for your other Pokémon.
