Yes. So if you were, say, Copying Black Kyurem-EX's Black Ballista, you would still have to discard 3 energy attached to M Gengar-EX. That said, if you only had two energy attached (through the use of Dimensional Valley) you would discard all of them, because you have to
do as much as you can (the is a general rule which applies to all things in the domain of "public knowledge", including all card in your discard pile, the number of cards in your hand or deck, and, yes, the number of energy cards attached to your pokemon).
However if Black Ballista read "Discard 3
[W] energy attached to this Pokemon, and you only had psycic energy on Gengar, you would discard nothing, because discarding no water energy is as much as you
can do.

Ok dont even play the TCG anymore but i can already tell this card will join Birthday Pikachu in the small list of banned cards for pokemon. If it does not then don`t be surprised if i get back into TCG with a Gengar Deck
Why do you think it should be banned? Birthday Pikachu was banned just because you couldn't effectively verify if it were a player's birthday without requiring them to bring their birth certificate (or other official documentation) to each game. That, and it conferred an unfair advantage to random players (even if that advantage wasn't that great). M Gengar-EX doesn't resemble that sort of situation at all. It's attack is just an expanded version of Zoroark BLW, which was an alright card but was by no means overpowered at any point in time...
