Alright, I activated an account with poke(r)beach just so I can discuss this issue. I find it reprehensible that Nintendo is taking legal actions against this fantastic site as well as others. It makes me question the moral integrity of this corporation.

Also, I LOVE the Colbertian satire that poke(r)beach as presented. With Dittos everywhere, links to really problems, and a name change, fantastic work! Whoever came up with that should really work for Stephen Colbert.

I'm willing to let this remain open, so long as discussion remains productive and mature. Also, I don't think they are taking any further legal action so long as the webmasters removed their content (which WPM obliged).

Draphoenix, in the future please have a more descriptive thread title. Thanks!
 
I don't get why Nintendo decided to do this now. Why now when they could've said 'don't upload images' when CoroCoro and Pokemon Sunday started leaking images and information about Pokemon Black and White.

The fact that Nintendo lawyers sent a cease and desist letter is a legal action itself.

But I am going to do the same thing for Nintendo and I hope this is an appropriate place to discuss my plan.

I have sent a letter to the Nintendo Corporation. I sent what follows...

Dear to whom it may concern,

I am commenting on the recent cease and desist letter Nintendo's legal team sent internet fansites for Pokemon. As shown on Pokebeach.com...

"We just received a letter from a Nintendo lawyer (edited to remove personal info obviously) asking to take down all of our Black and White images or bad stuff will happen. I called the lawyer through his law firm and he said he'll be making the rounds on other Pokemon sites as well. I was the first website on their list.... I have 24 hours to remove the images, which means they'll be gone by tomorrow afternoon (Sunday). Joy! Anyways, we'll continue to play the game and report what we find like we've been doing."

The site also commented in Colbertian satire how Nintendo is going after the wrong people. In an era where Pokemon games still have strong sales, and ROM use, the actual spread of the games for free, is on the rise, I agree with Pokebeach and others that Nintendo's legal actions are highly imprudent.

The free service Serebii.net has provided over the years has renewed the dying embers of my Pokemon activities every time they waned. Even when Nintendo favored those who lived in bigger areas in the United States and didn't allow easy access to event pokemon, sites like Serebii provided me hope. For example, using Serebii's chat feature, I was able to find 4th generation event pokemon. This allowed me to trade for the pokemon I wanted when Nintendo failed to provide me an easy point of access to specific pokemon.

I understand Nintendo's concern for copyright violation. It is not fair for the hard-working people at Nintendo to create a project and then not receive the benefits of their labor when people pirate their games. This is exactly the reason I have bought every single Pokemon RPG produced (Red,Blue,Yellow,Gold, Silver, Crystal, Sapphire, Ruby, Emerald, FireRed, LeafGreen, Diamond, Pearl, Platinum, HeartGold, SoulSilver, Stadium 1 and 2, Colosseum XD, and Battle Revolution)along with thousands of dollars in other Pokemon products over the course of my involvement with the Pokemon franchise. Moreover, I planned on purchasing both Pokemon Black and White when they came out in America. However, as the current release only affected Japan, I must wait several months before my next Pokemon fix. What can I do in the meantime? I can look at the wonderful graphics of the new Pokemon generation and the new designs for the next set of Pokemon. Needless to say, the fact that I cannot see new images of the games I cannot purchase in English disheartens me greatly.

Normally, I would boycott such unjust actions taken by a corporation such as yourselves. Luckily for the profits you apparently wish to protect over your fanbase, I will still buy your Pokemon products with a heavy heart. I say this as a reminder; fansites such as Serebii and Pokebleach nurture your fanbase when you leave it out to dry. It is because of my undying support of Pokemon created by the wonderful resources of Serebii that I will continue to buy your products. And I know I am just one of many who feel the same.

I hope alienating your fanbase by rejecting what you feel as copyright infringement protects the profits you are after,

Though I know my voice will not be heard, if others join this cause, then I hope there might be an outcry that Nintendo will actually listen to.

The services sites like Pokebeach provide are invaluable and should be protected.

I am also working on a Youtube video to represent my frustration, and hopefully my voice will be heard.
 
Have you asked for permission to use both PokeBeach and Serebii in you example? If they actually do pay attention to your letter it might end up negative for both of them.

Anyway event Pokemon are meant to be rare. A few of them spread thoughout the whole Pokemon community, that was the original meaning of it. But these days it looks like everybody has to have one.
 
Could it be possible that both Serebii and Pokebeach could make some sort of petition, just showing Nintendo, how many people are behind letting the Black and White images shown? Just a suggestion.

Draphoenix> Very good letter, I agree completely. I mean, Nintendo thrives on sites like these. Aren't these the places in which make MORE people want to buy the games? Some how, Nintendo doesn't see that. It's not like this is a hard core forum for criticizing the game, this is a forum for fans to express their love for pokemon, and currently, their love for Black and White. Honestly, if Nintendo, for some reason, decided to join the forums, how many times would they see people seeing "I am not buying this game, because you posted images of the game" None. Pokebeach, out of any fanbase site I've been on, is the best. Fantastically organized, and informative. I would hate to see that lost, because of something as ridiculously stupid as this.
 
Why is this an issue to Nintendo? There are ROMs being produced that mean that they gain no profit, and yet they are more concerned about American sites showing images of fictional creatures that doesn't really effect them at all, really only making fans more eager for the games? If we really wanted, it's not going to be very difficult to find them on a Japanese website is it?

My thoughts are as follows: 1. Nintendo, this is called free advertising!:( 2.Pokebeach should tone down the bashing of nintendo (even if it is stupid). 3.nintendo is sometimes (and I say this because somtimes they are) a kill joy. 4. I think its O.K. WITH EVERYPART OF ME THAT POKE'BEACH IS A AWSOME NAME AND SHOULD BE KEPT! Keep on rockin poke' freinds!{R}:cool:
 
@ llava: That's a good idea. I'm sure the petitions could easily get a couple hundred (maybe even a thousand) people sign it and then Nintendo would find out they made a mistake.
 
Who would start the petition though? We need somebody to step up as a leader and do this. (sorry for going off topic)
 
@ Jacobe: Maybe WPM or someone very important on the forum.

A petition is a good idea. It'll make the voice of the people who were unhappy over Nintendo's actions heard.
 
But you all have to realize this wouldn't make any sense. Of course you can ask why we won't be allowed to post images of BW, how can that cause damage to Nintendo? ROMs cause alot more damage. The thing is, these pictures are taken from ROMs. With that in mind I completely understand the actions of Nintendo. Though they should try to take the ROMs downs as well. However, that's almost impossible.
 
They do as far as I am aware. And by using pictures of the actual game is nothing wrong. They cannot accuse you for showing them. They should've been a bit more clear I think. But I don't see why you can't use the legal pictures. WPM is exaggerating this all a little bit, well.. a lot perhaps.
 
So then why did they say for WPM to take all pictures down instead of just the ones from the ROMS?, I mean it isnt that hard to tell if something was taken by a ROM and something by picture, so they could just say take the clearer ones down.
