An eBay buyer is claiming that she has not recieved an item from me.

I have the proof of postage and sent 2nd Class as I stated I would in the auction.

I've replyed to the case she opened (before she had even contacted me even though she said in the case she contatced me which is BS).

But I ask yous, what can I do and what do you think will happen?

RE: eBay Buyer

Send her a message and the proof. What I had to do one time with ebay, in the same situation, is that followed by contacting ebay and sending them the proof. I also always save postal receipts for up to 3 months or until feedback is left for me and things are good and done.

RE: eBay Buyer

yeah Ive done that.

If it goes to a full ebay review to determine the outcome will i lose or win?

RE: eBay Buyer

Usually lose unless you have tracking. Buyer protection is pretty lame. Ive gotton screwed in cases of buyers remorse

RE: eBay Buyer

Thats crap, it was a folder poke 56 holo pokemon cards so its not as though it was just one card i could send again :(

RE: eBay Buyer

Unfortunately, not having proof of shipment puts you at the mercy of your buyer.

If you do have tracking or even a customs number, make sure eBay gets it and you may win the case.

RE: eBay Buyer

I once sold codes and the buyer won, even with a screen shot of the email. 5 bucks gone though.

RE: eBay Buyer

When selling you need to weigh the cost of packaging and shipping against replacement.

RE: eBay Buyer

The person has the postal receipt I think. If you do lose a case, you can appeal to ebay. You can also call their customer support number before that happens.

RE: eBay Buyer

If your shipping does not have tracking + confirmed delivery then you are out of luck. You can talk to ebay and paypal as much as you want but you will not win the case. The only way to win the paypal/ebay case is to open a claim with USPS and have them do an investigation and confirm that it was delivered successfully to the correct address. I've been through this with a shipment to China. It took me 3 months to finalize everything. Sellers have little to no protection with ebay/paypal, sorry.

eBay AGAIN

IS a buyer allowed to contact eBay about the condition of some cards if they arent in good enough condition for him?

I stated they were very good to mint, he bought base set, jungle, fossil and team rocket sets from me and cost 65, 35, 15, 35 all together thats 150, he wants 75 dollars returned to him as he believes 17 cards are terrible condition (alkl were very good at least to me), i stated this on the auction as very good to mint and also stated no returns accepted, question is, does he have a case that he will win?

he wants either the 75 dollars refunded or he wants to send them all back, he said he will contact ebay for a full refund, but as i said i said i dont accept them and also they are as described

RE: eBay AGAIN

$75 for 17 cards in terrible condition? Sounds like buyer's remorse

RE: eBay AGAIN

exactly, unfair, and also can he leave negative feedback because of this or will that be removed from my record? ive reported him as he keeps damanding a refund

RE: eBay AGAIN

eBay can block feedback. I was unable to leave feedback for T&T, when they tried to scam me.

RE: eBay AGAIN

he has claimed through paypal and not ebay, does this make any differance? does my no returns policy stand and does the ebay description still count? hes claiming by saying they are unworthy to him

RE: eBay AGAIN

Since he is arguing condition, he may have to prove that they are in worse condition than stated.

RE: eBay AGAIN

That should not be a problem for him, he has the cards...
Hopefully you took pictures of the cards in question in case the buyer makes the condition worse to boost his case.

RE: eBay AGAIN

Sounds like he is being unreasonable.

Unfortunately, eBay and PayPal are a bit more favorable toward buyers than sellers..

Try to contact eBay or PayPal and explain how the buyer is using feedback extortion.

RE: eBay AGAIN

As long as you didn't say "these are 100% guaranteed mint!" and charge him 3x higher than any other card, you should be in favor.

ebay allows buyers to get a refund *if the item does not match the description* If you said it's very good (which to me: means the card has moderate flaws but still looks good in a binder) then he can't really complain. I'd say he bit off more than he can chew and is regretting his purchase cause he can't afford lunch until his next paycheck. Not to be mean or wisecrack.

Maybe you could pull up a grading scale of what very good condition means to show him. However unless you have high res photos of the cards, if he takes good quality pics of the cards and how bad the flaws are (he may even go as far as damage it himself to earn ebay's favor) you're kind of out of luck. I'm sorry.
